What is the offence ?
It is an offence to use a mobile phone whilst driving. This offence has a wide meaning and can apply to a number of situations.
If you have stopped your car and you are using your mobile phone with the engine running you can still be guilty of an offence. Even if you are supervising a learner driver, or an employer allowing or requiring your employee to answer their mobile phone whilst driving you could be guilty of using a mobile phone whilst driving.

The Penalty
You could receive a fixed penalty notice with a fine of £100 and 3 points on your licence.
Alternatively you may receive a summons for court and receive a fine and 3 points on your licence.
