When can a special reasons argument be used?
There are numerous offences where a special reasons argument could be put forward. These include:
- Drink drive offences
- Driving whilst unfit
- No insurance
- Speeding
These are just a few examples.
What do I have to show to the court?
You will have to show:
- Mitigating or extenuating circumstance
- Your reasons must not amount in law to a defence
- Be directly connected to the commission of the offence
- Be a reason that the court ought to take into consideration when imposing sentence
What kind of situations amount to a special reason?
Special reaons include:
- Unintentionally committed the offence or was misled into it
- Shortness of distance driven
- A true emergency
What is the process?
It is up to you to prove to the court that there is a special reason. The courts take a strict view of special reasons and anything put forward will be questioned in depth to determine whether there were any other options.
An application will be made to court and the court will set aside time to hear your case. Your case will need to be fully prepared considering all your circumstances and obtaining any additional evidence to be put to the court.
You will be required to give evidence under oath to the magistrates and you may also be cross examined by the prosecutor and asked questions by the legal advisor and the magistrates.
It will also involve providing the court with any documentary evidence and allow any additional witness to give evidence.
